Texas has specific laws governing auto insurance that every driver should understand. From minimum coverage requirements to penalties for non-compliance, knowing the rules helps you stay legal and properly protected. Here's a comprehensive look at Texas auto insurance laws and what they mean for you.

The Financial Responsibility Law

Texas operates under a "financial responsibility" law, which means every driver must demonstrate the ability to pay for damages they cause in an accident. The most common way to meet this requirement is by carrying auto insurance. Alternatives include posting a $55,000 surety bond or making a $55,000 deposit with the state comptroller — but these options are impractical for most drivers.

Minimum Coverage Requirements

Texas requires all drivers to carry liability insurance with minimum limits of 30/60/25 :

  • $30,000 bodily injury per person
  • $60,000 bodily injury per accident
  • $25,000 property damage per accident

These minimums apply to all registered vehicles driven on public roads. There are no exceptions based on vehicle age, type, or how infrequently you drive.

Proof of Insurance Requirements

Texas law requires you to carry proof of insurance in your vehicle at all times. You must show it:

  • During any traffic stop
  • At the scene of an accident
  • When registering or renewing your vehicle registration
  • During a vehicle inspection

Texas accepts both physical insurance cards and digital proof on your phone. The state's TexasSure electronic verification system also allows law enforcement to verify your coverage status electronically.

Texas Is an At-Fault State

Texas follows an "at-fault" (or tort) system for auto accidents. This means the driver who caused the accident is financially responsible for damages. The at-fault driver's liability insurance pays for the other party's injuries and property damage.

Texas also uses a "modified comparative fault" rule. If you're partially at fault for an accident, your compensation is reduced by your percentage of fault. If you're found more than 50% at fault, you cannot recover damages from the other driver at all.

Uninsured Motorist Laws

Texas insurers are required to offer uninsured/underinsured motorist (UM/UIM) coverage with every auto policy. While you can decline this coverage in writing, it's strongly recommended given that roughly 14% of Texas drivers are uninsured. If an uninsured driver hits you, UM coverage pays for your injuries and damages.

What About Out-of-State Drivers?

If you're driving in Texas with valid insurance from another state, your policy will generally extend coverage while you're visiting. However, if you move to Texas and become a resident, you must obtain a Texas auto insurance policy that meets the state's minimum requirements. You have 30 days after establishing residency to update your registration and insurance.

Penalties for Non-Compliance

Driving without insurance in Texas is a misdemeanor offense:

  • First offense: $175-$350 fine
  • Subsequent offenses: Up to $1,000 fine, license suspension, vehicle impoundment
  • Causing an accident while uninsured: Additional penalties plus personal liability for all damages

Additionally, if your insurance lapses, you may face a surcharge when reinstating your policy, and future premiums may be higher.
